On 31 March 2026, pursuant to the Act of 9 January 2026 amending the Act on Land and Mortgage Registers and Mortgage and the Act on the National Court Register, as well as the implementing regulations of the Minister of Justice of 24 March 2026, significant changes concerning documents issued by the Central Information of Land and Mortgage Registers will enter into force.
The most important change is that documents obtained through the ICT system of the Central Information of Land and Mortgage Registers – namely land and mortgage register transcripts, extracts from land and mortgage registers, and certificates confirming the closure of a land and mortgage register – will acquire the legal force of documents issued by a court, provided that they contain features enabling their verification against the data contained in the central database of land and mortgage registers. Printouts of such documents will have the same legal force as well.
The new provisions also further specify the features of electronic documents and the method of their verification. An electronic document and its printout will contain, in particular, a unique identifier enabling verification, the advanced electronic seal of the Ministry of Justice, a QR code, the website address used for verification of the document, and information on the date and time of downloading the data from the central database of land and mortgage registers. Verification will be free of charge and available for 24 months from the date of submission of the application. The validity of the document is not conditional upon completion of this verification procedure.
As of 31 March 2026, new fees for the activities of the Central Information of Land and Mortgage Registers will also apply. In the case of documents issued in paper form, the fee will amount to PLN 45 for an ordinary transcript, PLN 90 for a full transcript, from PLN 25 to PLN 45 for an extract – depending on the number of sections of the land and mortgage register – and PLN 15 for a certificate confirming the closure of a land and mortgage register. In the case of an application submitted via the ICT system for the issue of an electronic document allowing the applicant to prepare a printout independently, the fees will amount respectively to PLN 30 for an ordinary transcript, PLN 75 for a full transcript, from PLN 10 to PLN 40 for an extract, and PLN 10 for a certificate confirming the closure of a land and mortgage register. The fee for searching land and mortgage registers in the central database of land and mortgage registers will be PLN 30.
These changes are of significant importance for real estate practice. They facilitate the use of electronic documents, clarify the rules governing their verification, and expressly determine the current costs of obtaining documents from the Central Information of Land and Mortgage Registers. In practice, this means greater efficiency and greater predictability in the use of documents derived from land and mortgage registers.
